Smart Agent Terms and Conditions

By downloading, installing, accessing, or using the Smart Agent application ("App") or the Smart Agent website ("Web") (collectively referred to as the "Service"), you ("User") agree to be bound by these Terms and Conditions ("Terms"). If you do not agree with any part of these Terms, you must not use the Service.

1. Acceptance of Terms

Your use of the Service constitutes your acceptance of these Terms. If you disagree with any provision herein, you are required to discontinue use of the Service immediately.

2. Description of Service

Smart Agent is a cloud-based service provided through the App and Web, developed by Apna Infotech ("Company"), to assist vehicle insurance agents and RTO assistants in managing client data, vehicle insurance policies, RTO tasks etc, The Service provides tools for client management, policy ,RC , PUC , permit tracking, transaction management, and access to vehicle RC details and challan information.

3. User Responsibilities

As a User, you agree to the following:

• Maintain the confidentiality of your account credentials for both the App and Web.
• Use the Service only for lawful purposes and in accordance with these Terms, whether accessed via the App or Web.
• Ensure the accuracy and completeness of the information you provide through the Service.
• Undertaking Requirement: Obtain an undertaking from your customers authorizing the digital storage of their vehicle documents before using the Service (via App or Web). The Company is not responsible for any issues arising from your failure to obtain such undertakings.
• Verify the accuracy of vehicle information sourced from public platforms (e.g., Parivahan website), acknowledging that it may not always be accurate or up-to-date, and confirm critical details with official government sources.
• Not engage in any activity that could damage, disable, or impair the Service or the Company’s servers.

4. Data Privacy

The Company collects and processes user data in accordance with its Privacy Policy, available within the App and on the Web. We take reasonable measures to protect your data but cannot guarantee absolute security. Please refer to the Privacy Policy for detailed information.

5. Disclaimer of Warranties

The Service (App and Web) is provided "as is" and "as available" without any warranties, express or implied, including but not limited to merchantability or fitness for a particular purpose. Specifically:

• The Company does not warrant that the Service will be error-free or uninterrupted, whether accessed via the App or Web.
• The Company does not warrant the accuracy, completeness, or reliability of vehicle information provided through the Service.
• The Company is not responsible for any issues arising from your reliance on data from the Service.

6. Limitation of Liability

To the maximum extent permitted by applicable law:

• No Responsibility for Legal or Governmental Issues: Apna Infotech and Smart Agent shall not be responsible for any legal, lawful, or governmental issues, losses, damages, or liabilities arising from your use of the Service (App or Web), including but not limited to disputes with customers, violations of laws, or issues with government authorities.
• The Company shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Service.
• Third-Party Resolution: In the event of any dispute or issue arising from the use of the Service (App or Web), the matter will be resolved by a neutral third party in Nokha, Bikaner, and the Company will not be held responsible for the outcome.

7. Intellectual Property

The Service (App and Web) and its content are the property of Apna Infotech and are protected by copyright and other intellectual property laws. You may not reproduce, modify, or distribute any part of the Service without the Company’s prior written permission.

8. Third-Party Links and Data

The Service (App and Web) provides access to publicly available vehicle information from the Parivahan website. The Company is not responsible for the content, accuracy, or reliability of this information. The Company operates as an independent platform and is not affiliated with any government entity.

9. Modifications to Terms

The Company reserves the right to modify these Terms at any time by posting the revised Terms within the App and on the Web. Your continued use of the Service (App or Web) after such changes constitutes your acceptance of the revised Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from these Terms will be subject to resolution by a neutral third party in Nokha, Bikaner, as outlined in Section 6.

12. Severability

These Terms, along with the Privacy Policy (available on the App and Web), constitute the entire agreement between you and Apna Infotech regarding your use of the Service.
