Smart Agent Terms and Conditions

By accessing, installing, or using the Smart Agent application ("App") or website ("Web") (collectively the "Service"), you ("User") agree to these Terms and Conditions ("Terms"). If you do not agree, you must stop using the Service immediately.
1. Acceptance of Terms
Using the Service constitutes full acceptance of these Terms. You must discontinue use if you disagree with any part.
2. Description of Service
Smart Agent, developed by Apna Infotech ("Company"), is a cloud-based software solution designed to help insurance agents and RTO assistants manage client records, insurance policies, RC information, PUC, permits, challans, and other related data.
3. User Responsibilities
- Keep login credentials confidential and secure.
- Use the Service only for lawful purposes.
- Ensure accuracy of all data uploaded or entered.
- Obtain customer consent before storing their documents digitally. The Company is not liable for issues arising from your failure to obtain consent.
- Verify vehicle or challan details with official government sources as public data may be outdated or inaccurate.
- Not attempt to hack, modify, harm, or disrupt the Service.
4. Data Privacy
The Company handles user data as described in the Privacy Policy. While we use security measures, no system is fully secure. Users are responsible for safeguarding their account credentials and devices.
5. Service Fees and Subscription Adjustments
The Company may revise, update, modify, or adjust service fees or subscription charges from time to time based on operational requirements and market conditions. Such adjustments may apply to new purchases, renewals, or upgraded plans. By continuing to use the Service, the User acknowledges and accepts that any applicable charges or fee structures may be updated without prior individual notification.
The Company is not responsible for any financial impact, loss of business, or inconvenience resulting from such adjustments.
6. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. Specifically:
- We do not guarantee uninterrupted or error-free operation.
- We do not guarantee accuracy of public data fetched from Parivahan or any government site.
- We are not liable for decisions made based on data displayed in the Service.
7. Limitation of Liability
To the fullest extent permitted by law:
- The Company is not responsible for legal disputes, compliance issues, fines, or penalties arising from your use of the Service.
- The Company is not liable for indirect, incidental, or consequential damages, including loss of business, revenue, customers, or data.
- The Company is not responsible for errors in public data, API failures, downtime, or technical issues.
- Any dispute arising from use of the Service shall be resolved by a neutral third party in Nokha, Bikaner.
8. Indemnification
You agree to indemnify and hold Apna Infotech harmless from any claims, losses, damages, or legal actions arising from:
- Your misuse of the Service.
- Incorrect or illegal data uploaded by you.
- Your disputes with customers.
- Your failure to obtain required consent from customers.
9. Intellectual Property
All content, design, software, and features of the Service are owned by Apna Infotech. Users may not copy, resell, or reverse-engineer any part of the Service.
10. Third-Party Links and Data
The Service may fetch publicly available data from government sources such as Parivahan. We do not guarantee accuracy or availability of external data or third-party services.
11. Service Modifications
We may update, change, enhance, or discontinue any feature of the Service at any time without prior notice. We are not liable for any loss caused by such changes.
12. Termination
The Company may suspend or terminate any account without refund if:
- You violate these Terms
- You misuse the system or upload illegal/inaccurate data
- You attempt to access prohibited areas or harm the platform
13. Governing Law and Dispute Resolution
These Terms are governed by the laws of India. In the event of any dispute, claim, or disagreement arising out of the use of the Service, both parties agree that the matter shall be resolved exclusively through a neutral third-party mediator located in Nokha, Bikaner. The mediator’s decision shall be final and binding to the extent permitted by law.
No court proceedings shall be initiated unless mediation has been attempted and concluded.
14. Severability
If any clause is found invalid, the remaining Terms will continue in effect.
15. Entire Agreement
These Terms, along with the Privacy Policy and Refund Policy, form the complete agreement between the User and the Company.
