Welcome to the Milk Sarthi App! These terms and conditions ("Terms") govern your use of the mobile application and services provided by our app. By accessing or using the Milk Sarthi App, you agree to comply with these Terms.
1. User Eligibility and Acceptance:
a. Milk Collectors: Only registered milk collectors are permitted to use the app to record daily milk collection data. By registering, you represent that you are authorized to act as a milk collector.
b. Farmers or Suppliers: Any individual who wishes to record their milk collection data can use the app, provided they are 18 years or older and legally competent to enter into binding agreements.
c. Binding Agreement: By using the app, you confirm that you have read, understood, and agreed to be bound by these Terms. If you are using the app on behalf of an organization, you represent that you have authority to bind that organization.
2. Account Registration and Security:
a. Accurate Information: All users must provide accurate, current, and complete information during registration. You must promptly update your information if it changes.
b. Account Security: You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You must immediately notify us of any unauthorized use of your account.
c. No Account Sharing: You may not share your account credentials with any third party or allow any third party to access your account.
d. Account Termination: We reserve the right to suspend or terminate your account at our sole discretion if we suspect any violation of these Terms or fraudulent activity.
3. Daily Milk Collection Entry:
a. Data Entry: Farmers or suppliers can record their daily milk collection data through the app, including quantity, fat content, temperature, and other relevant information.
b. Data Access: Milk collectors can access the data recorded by farmers or suppliers for their records and analysis. This access is limited to authorized milk collectors only.
c. No Guarantee of Accuracy: We do not verify, validate, or guarantee the accuracy of any data entered by users. All data is provided "as-is" by the users.
4. Data Accuracy and User Responsibility:
a. User Responsibility: Farmers or suppliers are solely responsible for providing accurate and truthful information regarding milk collection. Any inaccuracies, errors, or false information are the sole responsibility of the user who entered the data.
b. Verification: Milk collectors should verify the data entered by farmers or suppliers for accuracy and completeness. Any discrepancies should be resolved directly between the parties involved.
c. No Liability for Data Errors: We shall not be held responsible or liable for any errors, inaccuracies, omissions, or false information entered by users. Users rely on the data at their own risk.
5. Data Privacy and Security Disclaimer:
a. Security Measures: While we implement industry-standard security measures, we cannot guarantee the absolute security of data transmission and storage.
b. No Liability for Breaches: We shall not be held responsible for any data loss, unauthorized access, security breaches, hacking, or any other security incidents. In the event of any security breach, we shall not be liable for any damages, losses, or harm suffered by users.
c. User Assumes All Risk: You acknowledge and agree that you use the app and transmit data at your own risk. We provide no warranties regarding data security.
d. Force Majeure: We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to natural disasters, war, terrorism, riots, acts of civil or military authorities, fire, floods, accidents, network infrastructure failures, or any other events beyond our control.
6. User Conduct and Prohibited Activities:
a. Legal Compliance: Users must comply with all applicable laws and regulations while using the app.
b. Respect Privacy: Users must respect the privacy and confidentiality of other users' information and refrain from sharing or misusing it.
c. Prohibited Content: Users must not use the app to post or transmit any harmful, offensive, defamatory, misleading, fraudulent, or illegal content.
d. No Reverse Engineering: Users may not reverse engineer, decompile, or attempt to extract the source code of the app.
e. No Commercial Use: The app is for personal/business use related to milk collection only. Commercial exploitation of the app or its data without our written consent is prohibited.
7. Intellectual Property Rights:
a. Our Ownership: The Milk Sarthi App and all its content, including but not limited to logos, designs, text, graphics, software, and all intellectual property rights, are and shall remain our exclusive property.
b. Restrictions: Users are prohibited from copying, modifying, distributing, selling, leasing, or creating derivative works from any part of the app's content without our prior written consent.
c. User Content License: By submitting data to the app, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and display the data as necessary to provide the app services.
8. Modification of Terms and User Responsibility:
a. Right to Modify: We reserve the right to modify, update, or change these Terms at any time without prior notice. We may update these Terms periodically at our sole discretion.
b. User's Responsibility to Review: It is your sole responsibility to regularly review these Terms to stay informed about any changes. Continued use of the app after any modifications constitutes your acceptance of the updated Terms.
c. No Individual Notifications: We are not obligated to individually notify each user about changes to these Terms. The "Last Updated" date will indicate when changes were made.
9. Comprehensive Disclaimer of Warranties:
a. As-Is Basis: The Milk Sarthi App and its services are provided strictly on an "as-is" and "as-available" basis without any warranties or guarantees of any kind, either express or implied.
b. No Warranties: We expressly disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, accuracy, reliability, completeness, timeliness, or non-infringement.
c. No Guarantees: We do not guarantee that the app will be uninterrupted, error-free, secure, or free from viruses or other harmful components.
d. Data Reliability: We do not guarantee the availability, accuracy, completeness, or reliability of any recorded data. Users rely on the data at their own risk.
10. Limitation of Liability and Release:
a. No Liability: To the maximum extent permitted by applicable law, we and our affiliates, directors, employees, agents, and representatives shall not be liable for any direct, indirect, incidental, special, consequential, punitive, or exemplary damages arising from or related to the use of the app or its services.
b. Damages Exclusion: This includes but is not limited to damages for loss of profits, data, business, goodwill, or other intangible losses, even if we have been advised of the possibility of such damages.
c. User Assumes All Risk: Users acknowledge that they use the app and its services at their own discretion and risk. You hereby release us from any and all claims, demands, and damages of every kind and nature arising out of or in any way connected with your use of the app.
d. Cumulative Liability Cap: In no event shall our total cumulative liability to you for all claims arising from or related to these Terms or the app exceed the amount of ₹100 (One Hundred Indian Rupees) or the amount you paid to us in the last 6 months, whichever is lower.
11. Indemnification:
a. User Indemnity: You agree to indemnify, defend, and hold harmless us, our affiliates, directors, employees, agents, and representatives from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:
i. Your use of the app
ii. Your violation of these Terms
iii. Your violation of any rights of any third party
iv. Any content or data you submit to the app
v. Any fraudulent, negligent, or wrongful act or omission by you
12. Dispute Resolution and Mediation:
a. Mediation Requirement: Any dispute, controversy, or claim arising out of or relating to these Terms, including the breach, termination, or validity thereof, shall first be attempted to be resolved through good faith negotiations between the parties.
b. Mediation Process: If the dispute cannot be resolved through direct negotiations within 30 days, either party may refer the dispute to mediation by a neutral third-party mediator mutually agreed upon by both parties.
c. Mediation Location: The mediation proceedings shall take place in Nokha, Bikaner, Rajasthan, India, unless otherwise agreed by both parties.
d. Cost of Mediation: The costs of mediation shall be shared equally between the parties, unless otherwise determined by the mediator.
e. Confidentiality: All mediation proceedings shall be confidential and without prejudice to the rights of the parties in any further proceedings.
13. Governing Law and Jurisdiction:
a. Governing Law: These Terms and any disputes related to them shall be governed by and construed in accordance with the laws of the state of Rajasthan, India, without regard to its conflict of law principles.
b. Exclusive Jurisdiction: If mediation fails to resolve the dispute, the courts in Bikaner, Rajasthan, India shall have exclusive jurisdiction over any legal proceedings arising from these Terms or the use of the app.
c. Waiver of Jury Trial: Both parties hereby waive any right to a jury trial in any legal proceeding arising out of or related to these Terms.
14. Miscellaneous Provisions:
a. Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
b. No Waiver: Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.
c. Entire Agreement: These Terms constitute the entire agreement between you and us regarding the use of the app and supersede all prior agreements and understandings.
d. Assignment: You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
e. Survival: All provisions which by their nature should survive termination shall survive, including but not limited to ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

3. IT IS YOUR RESPONSIBILITY TO REGULARLY CHECK FOR UPDATES TO THESE TERMS
4. YOU ACCEPT ALL RISKS ASSOCIATED WITH USING THE APP AND ITS SERVICES
5. YOU RELEASE US FROM ANY LIABILITY FOR DATA BREACHES, SECURITY INCIDENTS, OR DATA LOSS
6. YOU INDEMNIFY US AS SPECIFIED IN SECTION 11
